Rachel Maddow is a good as our corporate media will allow. However the "I" word to be used should be IMPEACHMENT now by the Congress and then let the next Justice Department take care of the next step INDICTMENTS. By not impeaching this Congress is saying that what Bush and Cheney have done is OK and it makes it that much harder for anybody to indict.
Does Sen. Levin think that the White House will comply with the subpeonas for his investigation. The VP on national TV just said that he approved torture. What are you waiting for? Prosecutors all across the country should be convening Grand Juries for indictments against these thugs.
Waterboarding is commonly referred to as "simulated drowning". It is not. It is "aborted drowning" and that would be aborted only if done so before the detainee actually drowns. There is absolutely no difference between drowning by waterboarding or by any other method. Your lungs fill with water and you are suffocated. Nothing simulated about it.
Jus Cogens refers to Peremptory norm or compelling law. From Wikipedia
"A peremptory norm (also called jus cogens or ius cogens, Latin for "compelling law") is a fundamental principle of international law which is accepted by the international community of states as a norm from which no derogation is ever permitted.
There is no clear agreement regarding precisely which norms are jus cogens — or indeed how a norm reaches the status of jus cogens — but it is generally accepted that jus cogens includes the prohibition of genocide, maritime piracy, slaving in general (to include slavery as well as the slave trade), torture, and wars of aggression and territorial aggrandizement."
These things can never be legalized. They are the foundation of international law. The war of aggression in Iraq also falls under Jus Cogens.
While we all get worked up with statements like Sen. Levin's call for another investigation, let's remember that the Democratic Party has just too many members who are complicit to differing degrees, i.e. Nancy Pelosi was on the Group of Four who approved the torture methods. The Democratic Party wants to get on with life. They could care less for justice.
We will get no justice from the Democratic Party.
