Conyers and Nadler Write to Mukasey Re His Defense of Torturers


Mukasey claims torturers are not guilty of any crime basically because they meant well and believed the sort of horsehit about "national security" that you'd hear in, say, a speech by Dick Cheney. Conyers and Nadler point out that the torture facilitating lawyers were well aware they were breaking laws. Scott Horton writes about this in Harpers. I highly recommend saving and printing the letter from Conyers and Nadler to send to Eric Holder at some future date when Conyers and Nadler fail to do so.

...that any judge who takes his or her job seriously and isn't aligned with the Constitution shredding Bush cabal would find that a "legal opinion" allowing torture is no substitute for the LAW, which clearly does not allow it.

MUKASEY:
"There is absolutely no evidence that anybody who rendered a legal opinion either with respect to surveillance or with respect to interrogation policy did so for any reason other than to protect the security of the country and in the belief that he or she was doing something lawful."

Of course, most of us can recall learning way back in driver's ed that ignorance of the law is no excuse.

Pretty sure that would apply to laws against torture too.

Bailout Double Standard

I wholeheartedly agree, Mr. Perry. Half of me believes Conyers is simply covering his butt by writing this letter of "protest", just like Hillary voting against FISA (knowing it would pass) and Dianne Feinstein protesting CIA enchanced interrogation (knowing it'd be vetoed by Bush), and thinking that this corrupt administration has blackmail files on everyone and they're hoping this new administration will clean up the previous. I think Mukasey fainted at that Federalist meeting because he knows the truth is hard on his trail (with that judge yelling "tyrant"). In short, I'm glad the message is still staying on top and more people are becoming aware. Popular consensus is slowly changing and people are getting used to the idea that the criminals can actually be convicted. Thanks to you, Mr. Swanson for all of your hard work. You are an unsung hero, FOR NOW!

Sounds like he looking at "intent", which doesn't hold water in areal court of law.
