Why post this video now? The bill Cafferty is talking about is the Military Commissions Act of 2006, and it passed. The video was posted slightly later than that.
No let's pull out our Constitution and turn to Article I, Section 9:
"... The privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.
No Bill of Attainder or ex post facto Law shall be passed."
So if the politicians can convince the Supreme Court that there is a rebellion, the fact that the Military Commissions Act is the antithesis of the constitution will not matter, it will still be upheld as the law as far as individual rights vs. concentration camps.
But the provision pardoning Bush's war crimes can be thrown out on procedural grounds. It may take some practice, and a receptive court.
