Fmr. Chief Guantanamo Prosecutor Says Military Commissions "Not Justice"

By davidswanson - Posted on 16 July 2008

DEMOCRACY NOW!

As the first military tribunal conducted by the United States in more than
half a century is scheduled to take place next week in Guantanamo Bay, Cuba,
we speak with Air Force Colonel Morris Davis, the former chief prosecutor at
Guantanamo. He resigned his position late last year in protest over what he
said was political interference. We speak with Col. Davis about his decision
to step down, torture at Guantanamo, and more. "If you're going to wrap this
under the banner of military justice, then it needs to be a fair trial,"
Col. Davis said. "What's taking place now, I would call neither military nor
justice."

Apparently this man thinks that it is OK to take people off the battlefield and lock them up forever because it is authorized by the treaty of Westphalia. I kid you not! He said that. I'm not sure if he has heard of the 4th Geneva Convention and the Nuremberg Principles, but he does know the treaty of Westphalia. Did we sign that treaty? WTF
