LAW SCHOOL TO ORGANIZE BUSH WAR CRIMES TRIAL

A conference to plan the prosecution of President Bush and other high administration officials for war crimes will be held September 13-14 at the Massachusetts School of Law at Andover .

"This is not intended to be a mere discussion of violations of law that have occurred," said convener Lawrence Velvel, dean and cofounder of the school. "It is, rather, intended to be a planning conference at which plans will be laid and necessary organizational structures set up, to pursue the guilty as long as necessary and, if need be, to the ends of the Earth."

"We must try to hold Bush administration leaders accountable in courts of justice," Velvel said. "And we must insist on appropriate punishments, including, if guilt is found, the hangings visited upon top German and Japanese war-criminals in the 1940s."

Velvel said past practice has been to allow U.S. officials responsible for war crimes in Viet Nam and elsewhere to enjoy immunity from prosecution upon leaving office. "President Johnson retired to his Texas ranch and his Defense Secretary Robert McNamara was named to head the World Bank; Richard Nixon retired to San Clemente and his Secretary of State Henry Kissinger was allowed to grow richer and richer," Velvel said.

He noted in the years since the prosecution and punishment of German and Japanese leaders after World War Two those nation's leaders changed their countries' aggressor cultures. One cannot discount contributory cause and effect here, he said.

"For Bush, Richard Cheney, Donald Rumsfeld, and John Yoo to spend years in jail or go to the gallows for their crimes would be a powerful lesson to future American leaders," Velvel said.

The conference will take up such issues as the nature of domestic and international crimes committed; which high-level Bush officials, including Federal judges and Members of Congress, are chargeable with war crimes; which foreign and domestic tribunals can be used to prosecute them; and the setting up of an umbrella coordinating committee with representatives of legal groups concerned about the war crimes such as the Center for Constitutional Rights, ACLU, National Lawyers Guild, among others.

The Massachusetts School of Law at Andover was established in 1988 to provide an affordable, quality legal education to minorities, immigrants and students from low-income households that might otherwise be denied the opportunity to obtain a legal education and practice law. Its founder, Dean Velvel, has been honored by the National Law Journal and cited in various publications for his contributions to the reform of legal education. #

People get real please. Bush and Co will never see any prison time or even the inside of a courtroom. The only thing he will have is a tarnished legacy. Thats it. Keep in mind this man is USA's (soon to be ex) president . If you think that the US is going to pack him up and ship him off to a foreign country you are crazy. Never mind that, If you actually think that a NATO country (with few exceptions) would bring him up on trial, you need to wake up. Also, even if a country did, it wouldn't go anywhere. Keep this in mind too; McCain could get elected, and wouldn't it be a shock if bush and Co. magically ended up absolved of any wrong doing after McCain takes power.

The point to a trial, even a mock trial, is that it will set a bigger base in which to try bush in the future. Yes, it will happen, even when people like you who try to spin that lie that no one will try cry. There are bigger minds than yours and mine that will go after the bush ledership, here and abroad, one at a time if need be, and bring public the whole rotten mess. People like you, and who ever is paying you to spin the no win, try not to look at the millions of people around the world that will try them in private,in their country, if the US does not, and pick them up if they ever go into that country. (Germany for one) Like Saddam Hussien thought no one could touch him, oh well...they did, and then they (the world) hanged him. We will see, in our lifetime, bush, cheney, rumsfeld, rice, tenet, among others...if no trial is forthcoming in the US, they will be tried in the courts of the people in other countries they have wronged, and they will start dieing of cancers, hit and runs, aids, bad press, and other magic diseases, if not just out-right disappeared or rendered. Furthermore, the people have long memories, and they will not forget what the bush administration did, not ever, you can say that is a lot of poo, but I beleive poo stinks and sticks. (have you smelled your shoes lately?) So, anyone who is caught helping those criminals are, in fact, harboring criminals...just like you are doing by trying to make people believe that there will never be a trial of the criminals in the bush whitehouse.

Paraguay has a new "leftist" government that's tired of being outside the international pale. It's considering amending its extradition (or lack thereof) treaties. So Bush & Co may have just wasted their money going to Paraguay. If nothing else, they may have problems going anywhere outside the US. Remember Pinochet!

Thimk! If bush could be held accountable would not he have already been by some legitimate prosecutor, and in court up on charges with sitting judge officiating. It's not like bush crimes are being held in a secret vault fer gud's sake.

The military and civilians in Japan responsible for the illegal and unprovoked attack on the America in 1941 were tried, convicted and executed as war criminals. The difference is that Bush and Cheney have yet to be tried and convicted and if found guilty---Executed as war criminals.

Now if you a saying that Japanese and German principles was brought before a combination allied military/civilian tribunal, tried, for war crimes and found guilty, and then executed or imprisoned..AFTER..the end of WW II that is correct.

There is a slim remote possibility that other nations could petition to have bush, cheney, et al ux other principles involved at sometime in the future but that remains to be seen doesn't it.

Hussein NEVER ATTACKED US! Never. He didn't have the ability to do so. So there is a big difference here. The US government(note I don't say the American people) also attacked a country that hadn't attacked us and wasn't a threat to us. As did the Japanese and Germany. BTW. Germany and Japan had a treaty that said who attacked one, attacked the other. I get really tired of people not understanding INTERNATIONAL treaties.

And another difference between Pearl Harbor and attacking Iraq are the numerous UN resolutions that were made against Iraq, and Iraq's violations of those resolutions.

Please excuse a novice but is there some reason, some right signed away by guys when entering the service that would preclude their families suing this administration in a class action wrongful death suit? I'm sure this has been thought of and it almost seems too easy....so what's the matter with that idea? I'm sure Cindy could lead the charge....now that we all know what she knew a long time ago.

This is not an ABA accredited school. This is a cheap attempt to draw attention to this place to further their own goals. They have filed suit with the ABA after they had their application for accreditation rejected, and continue to spill unqualified lawyers into New England. If my attorney went to this school, I'd think twice before going to court with them. This session is about as productive as throwing your own feces at a monkey.

If you guys want to be taken seriously and not as a bunch of crackpots, you can't make such arguments as, "He noted in the years since the prosecution and punishment of German and Japanese leaders after World War Two those nation's [sic] leaders changed their countries' aggressor cultures. What changed the "aggressor cultures" of those countries was losing the war and being occupied, not the fear of war crimes tribunals. Lawyers and writers should be keenly aware of fallacious claims of causality and the flawed argument of "post hoc ergo propter hoc" (after this, therefore because of this) and not use such fallacious reasoning.

They also cannot prove that the invasion of Iraq was a war crime unless you want to conduct the trial in North Korea, Cuba, or Venezuela. The defendants would successfully argue that the invasion of Iraq was justified because the US had indications of an immanent threat, Iraq had refused to let weapons inspectors complete their work, Iraq had a history of using chemical/biological weapons, and Iraq had defied numerous UN resolutions, not to mention Saddam's horrendous crimes against humanity. It would not be possible to get a conviction based on the invasion itself.

This is not to say that Bush, Rove, Cheney, Rumsfeld, Wolfawitz, Gonzales and others should not be prosecuted for numerous crimes. They should. Here are a few:

1) Human rights abuses, including violations of the Geneva Conventions and the US Constitution, most notably the failure to uphold the principle of Habeas Corpus. Essentially, they have run a Gulag in Guantanamo Bay on a par with the Soviet and Nazi concentration camps. They have also employed the same torture techniques (such as water boarding) used by Japanese officers during WWII and those crimes led to the execution of the convicted officers. These "war crimes" could be punishable, but the invasion itself would not be and cannot be equated with the unprovoked attack by Japan or the invasion of Poland by Germany in 1939.

2) Conducting politically motivated prosecutions, using US attorneys to trump up false charges against political opponents or to ignore offenses by political allies, and then dismissing those US attorneys who refused to participate in this criminal enterprise. Gonzalez should also be tried for perjury and contempt of Congress on this issue. Those US attorneys who acquiesced in the politically motivated prosecutions should also be charged with felonies, and that may actually start to happen soon.

3) Revealing the identity of a covert agent of the United States government, a felony. The fact that it was done as a political vendetta makes this even worse. It is a felony on its own and could also possibly bring the additional charge of treason. Rove and Cheney should be charged and convicted of these felonies.

4) Usurping the constitutionally defined congressional authority to regulate interstate commerce. This is a violation of the constitution and should be punished as a high crime. The Bush administration has clearly committed violoations of the constitution in numerous cases amid the protestations of Sen. Arlen Specter and others.

Trying to drum up nebulous war crimes charges that are open to a vast spectrum of political opinion and are apparently what this group in Andover is contemplating, comes across as juvenile and will not be taken seriously anywhere. It's posturing and grandstanding and looks ridiculous, and moreover will result in no real action. Let's focus on the well documented cases of violations of United States criminal statutes. Cheney first and foremost, followed by Rove, Gonzales, and others, are more than guilty of plenty of felonies on that score.

Why not ask this question: how was a special prosecutor with no clear charter other than to continue to investigate President Clinton until he could find any infraction, allowed to operate as a virtual fourth branch of government, and we cannot get a single special prosecutor appointed to investigate known felonies? This is the real problem we are confronting with the soviet-style Bush administration and their lapdogs in the republican congress, who are about to have their asses handed to them in the next election. Let's hope the next administration will prosecute the criminals.

I find it interesiting that you use in your first example WW2, since Prescott Bush, this current Presidents grandfather, was directly involved in the funding of Hitlers rise to power. He was the principal of several banks in NYC, linked with banks in Holland and Germany which directly funnelled cash to the right wing movements and the armaments and related industries in germany. This was going on 10 years before Hitler took power. This is all about war profit, and has been for over 100 years. Prescott Bushes' father, Samuel bush was directly invlved in WW1 as an expediter of arms dealers to supply that war after leaving a high federal post. Jump ahead to this current presidents father and there is Korea, Vietnam, and various other skirmishes and horrors, and of course The First Gulf War. There, in brief, is a four generation legacy of promting and profiting from manufactured wars so that war profiteers can fund and supply both sides. And the Bush family is just the tip of the iceberg. Ever wonder where the 'George W.' comes from? Think any of these guys will pay for their crimes? I dont believe they even think that they have done anything wrong.

you're right. there won't be. Bugliosi wants to prosecute, but at this rate, the only 'legitimate' organization in the united states of torture, is most likely, the 'krishna's' (bad choice, but you know what that means!) least they can break a ten spot for you at the airport, and not rip you off!

people are grasping for straws in the waning days of what still looks like 'order' but is the beginning of outright tyranny and the anarchy that will follow that.

they might as well tell everyone HALE-BOPP numero 2 is coming, and go off yourself so you can beam up to the mothership, that'd be kinder than giving people false hope these scummy filthy treasonous slime will be prosecuted.......*groan*
