Support Holt's Plame Investigation Bill


The BackBone Campaign and the After Downing Street Coalition are asking their members, allies, and all U.S. citizens to urge your Congress Member to Co-Sponsor Congressman Rush Holt's bill (H. Res. 363), calling for a Congressional investigation into the dangerous outing of Valerie Plame.

Tell them that you want a discharge petition to overcome the stonewalling of the Republican leadership. (A discharge petition, if signed by a majority of House members, forces a resolution to the floor of the full House.) Republicans have consistently stonewalled this crucial investigation, voting against investigating this illegal intimidation of a whistleblower and blatant violation of National Security EIGHT times since February of 2004!

Republican-controlled committees in the House defeated four separate Resolutions of Inquiry in September that were targeted at Bush as well as Secretaries Rumsfeld and Rice, along with AG Gonzalez. The next step is to get enough support for H. Res. 363 to generate a discharge petition and thus a vote on the full House floor. This bill should be debated and voted on there, on the floor of the full House of Representatives.

(The other four votes against an investigation took place in late January/early February 2004 when similar ROI's offered by Congressman Holt were also voted down by the respective committees of jurisdiction.)

In recent months, our coalition lobbied hard for a Resolution of Inquiry into the Bush Administration's lies that launched the war, H. Res. 375, sponsored by Congresswoman Barbara Lee. While the Resolution lost by one vote in the House International Relations Committee, we created debate, united the Democrats, persuaded a few Republicans to break ranks, and built an organization of grassroots lobbyists that took us from 39 co-sponsors to 83 in six weeks. What We Did.

That was just the beginning. Now, we need to stay focused and lobby for H. Res 363.

Unlike H. Res. 375, which was a privileged (time-sensitive) Resolution, H. Res. 363 can be kept alive with a discharge petition. We need all 202 Democrats and 16 Republicans to not merely cosponsor, but to sign a discharge petition to force a vote on the floor. There is no excuse for any Democrat not to sign onto this petition, and though Republicans will be pressured by the administration, it would be unethical for them to refuse as well.

Prosecutor Patrick Fitzgerald is currently investigating the leaking of Valerie Plame's identity as an undercover CIA agent. But we cannot be sure that he will indict for criminal charges. He is as like to indict for perjury, or not at all, as to indict for violations of the Intelligence Identities Protection Act.

Regardless, only Congress has the mandate to investigate the full complexity of the case, including the question of why White House staff was in possession of the information at all, prior to leaking it, and how their actions fit into the overall campaign of the Bush Administration to make sure that (in the words of the Downing Street Memo) "the intelligence and facts were being fixed around the policy." It is the responsibility of Congress to consider whether the existing Intelligence Identities Protection Act is adequate to insulate our intelligence agencies from political manipulation and retaliation.

The Bush Administration's campaign to block the investigation that H. Res. 363 would create has included this letter from the Department of Justice asking Congress not to investigate. This response from Congressman John Conyers and twelve Judiciary Committee Democrats shows that the DOJ request is without merit or precedent. In fact, Congressman Conyers sites many recent and historic examples in which a Congressional investigation and a criminal investigation have been held simultaneously.

RESOLUTION
Requesting the President and directing the Secretary of State, the Secretary of Defense, the Director of the Central Intelligence Agency, and the Attorney General to transmit to the House of Representatives not later than 14 days after the date of the adoption of this resolution documents in the possession of the President and those officials relating to the disclosure of the identity and employment of Ms. Valerie Plame.

Resolved, That--

(1) the President is requested to transmit to the House of Representatives not later than the date that is 14 days after the date of the adoption of this resolution, all documents, including telephone and electronic mail records, logs and calendars, personnel records, and records of internal discussions in the possession of the President relating to the disclosure of the identity of Ms. Valerie Plame as an employee of the Central Intelligence Agency during the period beginning on May 6, 2003, and ending on July 31, 2003;

(2) the Secretary of State, the Secretary of Defense, the Director of the Central Intelligence Agency, and the Attorney General are each directed to transmit to the House of Representatives not later than such date, all documents, including telephone and electronic mail records, logs and calendars, and records of internal discussions in the possession of the Secretary of State, the Secretary of Defense, the Director of the Central Intelligence Agency, and the Attorney General, respectively, relating to such disclosure during such period; and

(3) the Director of the Central Intelligence Agency, is directed to transmit to the House of Representatives not later than such date the results of any internal investigation by the Central Intelligence Agency into the disclosure of Ms. Valerie Plame as an employee of the Central Intelligence Agency, whether such results (or reports) are in draft or final form.
