Join Me in Calling on President Bush to Respect Congress’ Exclusive Power to Declare War

Dear Democratic Colleague:

As we mark five years of war in Iraq, I have become increasingly concerned that the President may possibly take unilateral, preemptive military action against Iran. During the last seven years, the Bush Administration has exercised unprecedented assertions of Executive Branch power and shown an unparalleled aversion to the checks and balances put in place by the Constitution’s framers. The letter that follows asks President Bush to seek congressional authorization before launching any possible military strike against Iran and affirms Senator Biden’s statement last year that impeachment proceedings should be considered if the President fails to do so.

I hope that you will join me in calling on the President to respect Congress’ exclusive power to declare war. To sign the letter below, please contact the Judiciary Committee staff at 225-3951.

Sincerely,

John Conyers, Jr.

Chairman

____________

May 8, 2008

The Honorable George W. Bush

President of the United States

1600 Pennsylvania Avenue, N.W.

Washington, D.C. 20500

Dear Mr. President:

We are writing to register our strong opposition to possible unilateral, preemptive military action against other nations by the Executive Branch without Congressional authorization. As you know, Article I, Section 8 of the U.S. Constitution grants Congress the power “to declare war,” to lay and collect taxes to “provide for the common defense” and general welfare of the United States, to “raise and support armies,” to “provide and maintain a navy,” to “make rules for the regulation for the land and naval forces,” to “provide for calling forth the militia to execute the laws of the Union, suppress insurrections and repel invasions,” to “provide for organizing, arming, and disciplining, the militia,” and to “make all laws necessary and proper for carrying into execution ... all ... powers vested by this Constitution in the Government of the United States.” Congress is also given exclusive power over the purse. The Constitution says, “No money shall be drawn from the Treasury but in consequence of appropriations made by law.”

By contrast, the sole war powers granted to the Executive Branch through the President can be found in Article II, Section 2, which states, “The President shall be the Commander-in-Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into actual Service of the United States.” Nothing in the history of the “Commander-in-Chief” clause suggests that the authors of the provision intended it to grant the Executive Branch the authority to engage U.S. forces in military action whenever and wherever it sees fit without any prior authorization from Congress. In our view, the founders of our country intended this power to allow the President to repel sudden attacks and immediate threats, not to unilaterally launch, without congressional approval, preemptive military actions against foreign countries. As former Republican Representative Mickey Edwards recently wrote, “[t]he decision to go to war ... is the single most difficult choice any public official can be called upon to make. That is precisely why the nation’s Founders, aware of the deadly wars of Europe, deliberately withheld from the executive branch the power to engage in war unless such action was expressly approved by the people themselves, through their representatives in Congress.”1

Members of Congress, including the signatories of this letter, have previously expressed concern about this issue. On April 25, 2006, sixty-two Members of Congress joined in a bipartisan letter that called on you to seek congressional approval before making any preemptive military strikes against Iran.2 Fifty-seven Members of Congress have co-sponsored H. Con. Res. 33, which expresses the sense of Congress that the President should not initiate military action against Iran without first obtaining authorization from Congress.3

Our concerns in this area have been heightened by more recent events. The resignation in mid-March of Admiral William J. “Fox” Fallon from the head of U.S. Central Command, which was reportedly linked to a magazine article that portrayed him as the only person who might stop your Administration from waging preemptive war against Iran,4 has renewed widespread concerns that your Administration is unilaterally planning for military action against that country. This is despite the fact that the December 2007 National Intelligence Estimate concluded that Iran had halted its nuclear weapons program in the fall of 2003, a stark reversal of previous Administration assessments.5

As we and others have continued to review troubling legal memoranda and other materials from your Administration asserting the power of the President to take unilateral action, moreover, our concerns have increased still further. For example, although federal law is clear that proceeding under the Foreign Intelligence Surveillance Act (FISA) “shall be the exclusive means by which electronic surveillance” can be conducted within the U.S. for foreign intelligence purposes, 18 U.S.C. 2511(2)(f), the Justice Department has asserted that the National Security Agency’s warrantless wiretapping in violation of FISA is “supported by the President’s well-recognized inherent constitutional authority as Commander in Chief and sole organ for the Nation in foreign affairs”.6 As one legal expert has explained, your Administration’s “preventive paradigm” has asserted “unchecked unilateral power” by the Executive Branch and violated “universal prohibitions on torture, disappearance, and the like.”7

Late last year, Senator Joseph Biden stated unequivocally that “the president has no authority to unilaterally attack Iran, and if he does, as Foreign Relations Committee chairman, I will move to impeach” the president. 8

We agree with Senator Biden, and it is our view that if you do not obtain the constitutionally required congressional authorization before launching preemptive military strikes against Iran or any other nation, impeachment proceedings should be pursued. Because of these concerns, we request the opportunity to meet with you as soon as possible to discuss these matters. As we have recently marked the fifth year since the invasion of Iraq, and the grim milestone of 4,000 U.S. deaths in Iraq, your Administration should not unilaterally involve this country in yet another military conflict that promises high costs to American blood and treasure.

Attacking Iran would just be one more of a numerous list of crimes of the Bush regime. Don't get me wrong, I am opposed to any more crimes, so I suppose we must now ask our congresscritter to send a letter to "The Honorable, not" W and tell him that attacking other countries is unacceptable. OMG.
4Peace

Our country can not survive an attack on Iran and Syria.

Bush has already with his many corrupted policies , tax welfare to the elite -- corporations and illegal war against Iraq has destroyed our economy and military.

Looks as if Bush/Cheney are intentionally destroying our economy and military.

There is no d... CEO with the experience that Cheney has would promote and push the policies he has and not know that they are destructed to our economy and military.

So it looks as if there is so motive behind their actions....

"We agree with Senator Biden...if you do not obtain the constitutionally required congressional authorization...impeachment proceedings SHALL be pursued."

But at least Congress is attempting to stand up after eight years of cowering down to Cheney/Bush.

"...it is our view that if you do not obtain the constitutionally required congressional authorization before launching preemptive military strikes against Iran or any other nation, impeachment proceedings should be pursued."

SHOULD be pursued? Who's sending this letter? The chairman of the House Judiciary or the president of the ladies auxiliary?

How about WILL be pursued?

But even if it were worded like Conyers was serious about accountability, why should another couple of million innocent people have to die, and why should another country have to be destroyed, and why should we have to put our unborn great grandkids into hock for their entire lives before these murderers are held to account? AND WHY HAVE THEY YET TO BE HELD ACCOUNTABLE FOR THE MOUNTAIN OF CRIMES THEY HAVE ALREADY COMMITTED?

Just when you thought these people who are supposed to be honoring our will couldn't get any more pathetic, along comes yet another half-assed effort from Conyers to make it look like he's serious about stopping the needless killing and destruction.

Screw your worthless letter, Mr. Conyers. Act on the evidence you already have. Do the job you swore you would do or step aside for someone who's willing.

Your TV is not your friend.

John,

I concur. The cowardly Conyers has run amuk since his darling Nancy Pelosi took over the house.

He was the House Representative who held hearings to Impeach George W. in the basement of the House.

Trust me John, the fix is in.

Neither John Conyers or Nancy Pelosi is going to do anything to upset the election cycle.

Democrats Pelosi and Conyers win in November 2008 and the rest of us get to suck on their tit.

Troubled

The word SHALL in law is generally accepted by case law to have been interpreted as meaning "will."

After the deed is done, Bush actually attacked Iran on his own, Congress will quickly rally around the flag and give their total support to their president and our brave troops in yet another military battle, this time against Iran.

The president's approval will skyrocket and the voters will look to the Repugs to save them from the Iranians. The Repugs win big in the '08 elections taking back both houses of Congress and keeping the White House. The President is honored as a hero.

"Should Have..." John Conyers steps down as Chairman and Rep F. James Sensenbrenner returns to the job in glory. Conyers won't be able to get even one signature on his impeachment bill so he'll have to document everything that happened. His dream of waiting for his next democratic president Barack Obama to be safely sworn into office before even scheduling an impeachment hearing was nothing but a pure fantasy while he let the clock run out on the 110th Democratic Congress.

Conyers once again puts his trusty pen to paper and writes yet another successful, voluminous Article entitled "Why I Should Have Impeached...Part II".

Every Democrat needs to sign a statement that they will immediately start impeachment proceedings if Bush/Cheney attack Iran.

MOREOVER, THE STATEMENT SHOULD INCLUDE THAT THE DEMOCRATIC PARTY WILL RECOMMEND THAT BUSH AND CHENEY BE TURNED OVER TO THE HAGUE IN ORDER TO PURSUE THEM FOR WAR CRIMES.

I would like to know what is the hold up already... DON'T YOU DEMOCRATS REALIZE YOU WERE ELECTED BY A W I D E MARGIN TO DO THE WILL OF THE PEOPLE. Look at the damage your inactivity has wreaked... and this is a short list...

What's the difference between Vietnam and the Iraq War?----
Cheney/Bush both had exit strategies to get themselves out of Vietnam.

Iran has not invaded anyone for over 200 years. Imagine the paranoia of innocent Iranian citizens, women, children, grandparents who only ask to be left alone yet they must now deal with the fear of a lying, international murderous sociopath.

What have we learned?

1) There were no Iraqi "Box Cutters" on "9/11", Iraq had nothing whatsoever to do with "9/11", America was never attacked or threatened by Iraq, Osama Been Forgotten has been dead for six years and Iran has not invaded anyone for over 200 years.

2) While Saddam was not a benevolent Dictator, he had nothing whatsoever to do with "9/11", he was not supporting "Al Qaeda" (toilets), he was not trying to purchase yellow cake uranium from Niger, he had no "WMDs" but he wanted to sell Iraq's oil in the Euro. Bush and his daddy's cronies are all Oil Robber Barons. Since the 2000 "selection", oil prices have increased by over 600% and Exxon named an Oil Tanker after Condi Rice.

3) Bush made a fool out of himself in 2003 by swaggering aboard the USS Abraham Lincoln dressed in Flight Gear like a spoiled little brat in front of a "Mission Accomplished" banner and proclaimed " combat operations in Iraq have ended. The United States and her "Allies" have prevailed". There is still a $50,000 reward for anyone who ever saw him report for duty ONE time during the year that he was AWOL from the Air National Guard. Cheney avoided military service during a time of war with 5 deferments and he has no conscience whatsoever about sending US soldiers into harms way with bad food, contaminated water, inadequate training and equipment. (If any of us had been AWOL for one day we would have been sent to prison.)

4) $2.3 trillion dollars is still missing from the US Treasury and Bush says that our Constitution is just a "goddamned piece of paper".

5) When Bush exploited US soldiers to attack and occupy a sovereign nation that never posed a threat to America, it was a war crime then and it is still a war crime now.

6) When over 1.2 million human beings are raped, tortured, plundered and murdered it is not "collateral damage". It is grotesque mass murder. When compounded with the displacement/destruction of over 5 million unarmed women, children and radioactive contamination of Mesopotamia, it constitutes a Holocaust which is illegal and amoral. Probably would have been less costly to purchase Iraq's oil honestly instead of trying to steal it.

7) Neocruds like Cheney, Bush and Zionist Israeli elements have enriched themselves with obscene war profits ever since "9/11" at America's expense and America's demise.

8) The Center For Public Integrity has documented over 935 Neocrud lies during the two year buildup for Bush's bogus war. So if Bush says that water is wet then everyone should turn on the shower to verify it.

9) No matter how hard the Zionist owned mainstream corporate media rubs or "spins" (Faux News Nutwork of Adolescent Sleazy Tabloid Trash Propaganda/Lies ), bovine excrement cannot be polished or shined, they still look stupid trying to do it and the same Chicken Hawk Neocruds are repeating the same lies again to defraud America into a Nuclear Holocaust against Iran. Russia has made it clear that an assault against Iran will be interpreted as an assault against Russia. Iran will certainly retaliate by blocking logistics/supplies/oil in the Gulf of Hormuz, the consequences of which would be fatal for our broken military and would certainly push oil prices above $200 dollars/barrel overnight. $10 dollar a gallon gas anyone? The results of a Russia/China/India retaliation could be too terrible for this planet to contemplate. So, who the hell cares how many veterans are in who's family? At this point it's an obsolete "Republican talking point". Lots of older veterans are way fed up with the chicken hawk bullshit lies and I am one of them.

10) We were right. The only "conspiracy nuts" are the knuckle dragging sycophantic wingnuts who still worship Bush and the Neocruds. There is so much more that I could write but lets savor that for awhile shall we?

This is one of the most important chapters in American history that I know of, because its when the wealthy few attempted to steal the country from the people, they committed treason plain and simple, the only time since the nation's infancy where our country would be taken from us, and they got away with it then and now because they did win in the end. They stole it, they did what no outside force could do and destroyed our democracy, our republic. But it can be undone. Since they have broken the justice system their extrdition to the Hague's World Criminal Court would be most appropriate. After their ill begotten financial assets have been seized, give them a fair trial for the civilized world to see.

It is our country after all, not a thing to be exploited by these traitors whose predecessors should have paid for their crimes. We can take it back, I really know it is possible.

Thank You

"Iran will certainly retaliate by blocking logistics/supplies/oil in the Gulf of Hormuz, the consequences of which would be fatal for our broken military and would certainly push oil prices above $200 dollars/barrel overnight."

What I think many people don't understand is that this is why Cheney/Bush refuse to stop buying up oil for our strategic oil reserve...they're hedging their bets, knowing that an attack on Iran would interrupt the oil supply, but still stupidly believing "the United States and her allies would prevail" and we'd then have all the oil we could ever want. What criminal morons this president and vice president are....

he hasn't been impeached because Cheney would become president. at least we have an idiot running the show and hope we won't have it held against us in the long run. if Cheney takes the reigns (actually quite intelligent), he might actually start WW3 as opposed to just giving the rest of the world a motive.

There has been a Legal Precedence established for Veterans making an Armed Insurrection on Dishonest and Corrupt Govt. in order "To Restore" a Proper and Honest Govt. All one has to do is research " The Battle for Athens" Athens Tenn 1946 where Former GI's trying to establish honest elections were bullied by the Sheriff who took the ballots to the jail to be counted in private. ( short version ) The Ex-GI's opened the armory and put the jail under siege untill the deputies surrendered. Several other towns offered armed citizen support. In addition several other towns in Tenn barely avoided similar incidents.
I took an oath to protect this nation from enemies both foriegn and domestic, and I have no doubt we are facing a domestic one of vast proportions. Its my opinion we need a thousand tractor trailers full of Armed Veterans to assault and take command of the Capitol Building and get these morons to put a stop to this.

Man, what a SCATHING critique! EXCELLENT JOB!!!

JC has become a caricature! - gangstergovernment.com

What? is it April 1st again?

The PNAC document signed in 2000 identifies Iran as the pot of gold at the end of the rainbow, using Iraq, Lebanon, Syria, and Afghanistan as mere stepping stones. Neocon assets have worked relentlessly to capitalize on global war and energy monopoly by inciting violent domestic and foreign conflict. Their strategy for overcoming popular rejection of preemptive-war includes stripping every international treaty and domestic check and law, every person standing on Constitutional Objections, and a mantra along the lines of, "What ever we can get away with-as long as we can".

So, now that Russia, China and India have all made perfectly clear (as of this past fall) that Iran is off limits to the PNAC agenda (which nobody in Congress but Kucinich and Paul has ever read), Conyers can now put on a constitutional show of strength, the "I" word uttered in public, and really truly threaten our Criminal President with real consequences if he does what Russia, China and India have already forbidden... See! Conyers cares about our country!

Pure Fleecing of the Constitutional Restoration Movement in the US. You'll be able to tell your DU-irradiated grandchildren that Conyers Threatened to Impeach the world's dictator-in-chief, but he didn't have the votes before he held hearings so he was unable to do anything except threaten him... great news, great honor, great country and hurray for freedom.

ixoxi

that the President will not attack Iran to issue a "threat" like this.

I'll bet Bush is really scared now!
4Peace

The guy has less than 6months left in his presidency, don't you think it's a little late to Act. This is more a political move than it is affective. I'm a democrat and the party we elected is weak and the republicans know it.

Conyers says that Bush should "seek congressional approval" before attacking Iran. FUCK THAT. Goddamn spineless pussy. How about saying "DONT FUCKING DO IT SHITHEAD", not "pwetty pweeze ask for appwoval pweeeeeeze sir?"

Where the fuck has all the courage gone? Was it all traded for default credit swaps and election funds?

[Before you read this, please note that I GREATLY respect David Swanson and all of his efforts.]

http://georgewashington2.blogspot.com/2008/05/why-john-conyers-threat-to...

John Conyers is so full of shit!

Don't anybody be fooled by him.

But Conyers is saying that all the war crimes and violations of the Constitution up to now are ok, but they just better not do anymore or this time we really will impeach?!? WTF.

The fact that Conyers feels he has to make this threat is exactly reason why Bush should have been impeached already - Bush is dangerous and irrational and cannot be trusted in control of our military.

I wish that Bush would agree to meet with Ahmadinejad. Sadly, however, it’s doubtful that Bush will seriously give negotiations a chance.

Experts have been predicting that Bush would authorize a strike on Iran for years:

“I believe President Bush is going to order air strikes (on Iran) before he leaves office”
-Norman Podhoretz (Lyons, 2007).

Bush and his cronies say they want peace and diplomacy, but the problem with the members of Bush administration is that you can’t trust them. You can’t take what they at face value.

The administration secretly planned and prepared for war with Iraq without disclosing it to the general public.

Yet, when asked about Iraq, Bush’s favorite response was “I have no war plans on my desk.” At one point or another after the planning began, nearly every member of the administration publicly denied any plans to go to war with Iraq.

The question remains: Why would we expect the Bush administration to start being honest and up front about its intentions now?

A better approach to Iran would be negotiations. We need to give Iran an honorable path of retreat. While Fareed Zakaria agrees that there is no reason not to use sanctions and embargoes against states such as Iran, he suggests that we also need to “allow a viable way out.” That is to say, we need to negotiate and not merely mandate.

I think we should more concerned about acquainting ourselves with the realities of Iran’s foreign policy initiatives, and intelligently determining our most reasonable course of action.
