This is a forum for common sense people that realize there is more at stake and more to consider than just electing a president.

I don't expect many ADS members to contribute, but I suspect the few thay may contribute will agree there is much more to consider and their posts and replies will demonstarte it on any topic they bring forward for discussion.

All topics and suggestions with exception of the presidential campaign/election are open. This topic is being beaten to death in other forums. I was hoping impeachment could be avoided in this forum but find that its too paramount an issue on people's minds. So fire away.

However everyone should feel free to write anything thet wish, UNCENSORED but not necesarily with expectation of not completely ignored.

I don't own this open to the public forum anymore than anyone else owns any other forum.

I wonder if it would help for us to petition Obama to urge Conyers to proceed with impeachment.

Maybe someone can use that Open Letter I wrote and put together a petition out of it.

The only reason I say Obama is because Conyers mentioned his candidacy as the reason he doesn't impeach. We know that is BS, but if someone as popular right now as Obama is, were to publicly urge Conyers, he may have to proceed.

Anything is worth a try. I think you would have to make such a petition an email sent out so it could be returned

Personally I've given up hope that anybody, prez candidate, or anyone in congress is going to push for impeachment, which is being hashed and rehashed in the impeachment discussions forum.

Did you receive a letter from Wexler asking you to write questions for General Petraeus that Wexler intends to ask on C-SPAN either tomorrow or Wednesday? I submitted three questions the commander in the field should be completely able to respond to:

What is the unvarnished truth about troop moral in Iraq and are you willing to let randomly chosen at G I's
on every front the field speak out freely without any form of duress or threat of punishment in order for the
national news media including C-SPAN to air their comments unedited?

When are you going to finally tell george bush that fighting a guerilla war against an unknown unidentifiable
enemy in a conventional manner with a conventional army is futile at best and destructive to both men and
material?

The military bases already completed or still under construction, are they established bases for billeting G I's rotating in and out of Iraq for years and decades to come and as alleged permanent, or not?

Memo linked to warrantless surveillance

WASHINGTON—For at least 16 months after the Sept. 11 terror attacks in 2001, the Bush administration believed that the Constitution's protection against unreasonable searches and seizures on U.S. soil didn't apply to its efforts to protect against terrorism.
That view was expressed in a Justice Department legal memo dated Oct. 23, 2001. The administration on Wednesday stressed that it now disavows that view.

The October 2001 memo was written at the request of the White House by John Yoo, then the deputy assistant attorney general, and addressed to Alberto Gonzales, the White House counsel at the time. The administration had asked the department for an opinion on the legality of potential responses to terrorist activity.

The 37-page memo has not been released. Its existence was disclosed Tuesday in a footnote of a separate secret memo, dated March 14, 2003, released by the Pentagon in response to a Freedom of Information Act lawsuit by the American Civil Liberties Union.

"Our office recently concluded that the Fourth Amendment had no application to domestic military operations," the footnote states, referring to a document titled "Authority for Use of Military Force to Combat Terrorist Activities Within the United States."

Exactly what domestic military action was covered by the October memo is unclear. But federal documents indicate that the memo relates to the National Security Agency's Terrorist Surveillance Program, or TSP.

That program intercepted phone calls and e-mails on U.S. soil, bypassing the normal legal requirement that such eavesdropping be authorized by a secret federal court. The program began after the Sept. 11 terrorist attacks and continued until Jan. 17, 2007, when the White House resumed seeking surveillance warrants from the Foreign Intelligence Surveillance Court.

White House spokesman Tony Fratto said Wednesday that the Fourth Amendment finding in the October memo was not the legal underpinning for the Terrorist Surveillance Program.

"TSP relied on a separate set of legal memoranda," Fratto told The Associated Press. The Justice Department outlined that legal framework in a January 2006 white paper issued by the Justice Department a month after the TSP was revealed by The New York Times.

The October memo was written just days before Bush administration officials, including Vice President Dick Cheney, briefed four House and Senate leaders on the NSA's secret wiretapping program for the first time.

The government itself related the October memo to the TSP program when it included it on a list of documents that were responsive to the ACLU's request for records from the program. It refused to hand them over.

Late Wednesday, Justice Department spokesman Brian Roehrkasse said department officials believe the October 2001 memo was not about the eavesdropping program, but he did not explain why it was included on requests for documents linked to the TSP.

Earlier, Roehrkasse said the statement in the footnote does not reflect the current view of the department's Office of Legal Counsel.

"We disagree with the proposition that the Fourth Amendment has no application to domestic military operations," he said. "Whether a particular search or seizure is reasonable under the Fourth Amendment requires consideration of the particular context and circumstances of the search."

Roehrkasse would not say exactly when that legal opinion was overturned internally. But he pointed to the January 2006 white paper.

"The white paper does not suggest in any way that the Fourth Amendment does not apply to domestic military activities, and that is not the position of the Office of Legal Counsel," he said.

Suzanne Spaulding, a national security law expert and former assistant general counsel at the CIA, said she found the Fourth Amendment reference in the footnote troubling, but added: "To know (the Justice Department) no longer thinks this is a legitimate statement is reassuring."

"The recent disclosures underscore the Bush administration's extraordinarily sweeping conception of executive power," said Jameel Jaffer, director of the ACLU's National Security Project. "The administration's lawyers believe the president should be permitted to violate statutory law, to violate international treaties and even to violate the Fourth Amendment inside the U.S. They believe that the president should be above the law."

"Each time one of these memos comes out you have to come up with a more extreme way to characterize it," Jaffer said.

Hi, there, I'm new here, and I was horrified by what I read about Mr. Yoo and his memos several days ago. I did, however, recall that Senator Kennedy grilled Alberto Gonzales at length about a Yoo memo at his confirmation hearing in early '05. Other Senators had questions and comments as well, but Kennedy was like a dog with a bone on the subject. Not that he got a lot, if anything, of value from the nominee. Specter kept trying to get Kennedy to hurry up, wrap it up (hush it up?), but he was like a dog with a bone. His questions were specific enough and detailed enough that I can only conclude that higher-ups on both sides of the aisle knew far more about Mr. Yoo and theories than they let on. Yet, those memo "findings" were not disavowed for a full two years after they were written, and after they had arguably tainted everything they touched that had to do with law and/or justice here and abroad. I am sure I am the least knowledgeable on this subject, and I would appreciate any tips about where I could read and/or watch more material. Many Thanks!

I remember something about some other Yoo memo quite awhile ago and like an idiot brushed it off. I won't make that mistake again.

With all these pearls getting leaked it surely looks like things are coming to a full boil for george w bumpkin and the bushites.

Now if the Democrats will stop sitting on the dime and take action, do something positive fer chrismus sake...that's the $64,000.00 question that seems to have come to a grinding halt getting answers to. Thanks, T.P. I agree that anything the Dems could do, might do, might think about doing, is indeed better than nothing at all. But, you see, I was of age and vocal and active during the Vietnam era..... A different kettle of fish - to my continuing shock and surprise - from the apathy I am surrounded by today. So, I am glad indeed to find all these wonderful people at "After Downing" who are clearly not afraid to say what they think. I am a Yankee transplant to the south, as well, and I guess that makes more of a difference than I anticipated. The people here are just as smart, and just as opinionated, but somehow "going on the record" is an alien urge. Or is that just McCarthyism Redux in the air? I can never quite decide.............. I never anticipated we would have another debacle of a war like this, OR another president seeking to quash the civil liberties of those who disagree with him like this, again in my lifetime. I have figured one of two things about Monica Jewenski,

Clinton was not impeached for getting a blow job. He was impeached for lying under oath about getting a blow job. The point is CLINTON SHOULD "NEVER EVER" been asked the question in the first place, under oath, or otherwise period!

If extramarital sex is a crime and lying about having extramarital sex is a crime...then at least half the married men AND women in this nation in both the public and private sectors are in deep deep shit.

He actually replied! Not what I wanted but what I got...now I feel a little obligated, since I shot my mouth off, I never expected to get a reply, to go to his website (something he may soon regret) to see what there is to see.

Any Democrat that gets my vote had damned well better have a backbone, guts, and a ramrod stuck in his ass reinforcing his backbone labeled "I represent, and am answerable, and responsible to my constituents."

But I still want to see it in a email sent directly to me sent from him; something tangible and concrete binding him to his word. Because these politico's, any of them in either party, can put anything they want on their websites then delete and deny it later...when in a direct email that can be retained AND printed out with date and time stamp there is no way in hell to redact or deny what they say later.

Two of the most dangerous words politicians have in their possession and consider assets, are, "Plausible Deniability" that enables them to declare, "I didn't even know...one of my staff must have put something there without my knowledge or permission, this information was withheld from me, etc. etc ad infinitum."

So knowing this, it's pretty hard to "trick" this old I'm from Missouri dog with old or new tricks.

This notion has been lost in every aspect due to affectations resulting in adverse effects that touches virtually all in varying degrees, with the exception of the upper 5% or our populous and has brought this nation to the brink of total failure; a position this nation has been for the first time since the same type adversities that divided this nation that resulted in a war between the states well over one hundred years ago.

This is where inflexible classism in this nation has brought us Jim; to a point where the minority upper class have colluded and determined that they the few will dictate to all and rule over all, including our elected law making governing bodies at each level of our government, as well as the same for other nations dictating and at least attempting to rule over their peoples and governments no matter what the cost, monetary or human.
